Preamble
Smrtlife AG offers a digital platform for wellness analytics. Currently, the software is in a closed "Friendly User Test" (Beta Phase). By participating, you agree that the product is still in development.
Please note that our product is not a medical product and is not intended to provide medical advice, diagnoses, or treatments. Users must consult appropriate professionals for medical or other specific inquiries. Please refer to the Intended Use.
1. Scope
1.1 These Terms and Conditions (“Terms”) apply to all agreements and the use of the software provided by Smrtlife AG.
1.2 By accessing or using our software, you agree to these Terms. If you do not agree, you must immediately stop using the software.
2. Beta Disclaimer & Risk Acknowledgment
2.1 Work in Progress: You acknowledge that the software is a pre-release version. It may contain bugs, errors, or incomplete features (e.g., OCR misreadings).
2.2 No Reliance: You agree not to make any health decisions based solely on the Beta Software's outputs without verifying the original lab report and consulting a doctor.
2.3 Data Integrity: While we use high security standards, data loss may occur during testing updates. You should always keep your original PDF lab reports safe.
3. Intellectual Property
3.1 All rights to the software, including but not limited to code, design, logos, and trademarks, remain the exclusive property of Smrtlife AG.
3.2 During the beta testing phase, users are granted a limited, non-transferable, and revocable license to use the software.
4. User Obligations
4.1 Feedback: As a Friendly User, you are invited to report bugs or usability issues to help us improve.
4.2 Privacy Filter: You agree to use the provided redaction tools to mask direct identifiers (Name, DOB) before finalizing your upload, as described in the user instructions.
5. Liability
5.1 Free Service: As this service is provided free of charge during Beta, Smrtlife AG’s liability is limited to intent and gross negligence. Liability for slight negligence, lost data, or indirect damages is excluded.
6. Data Protection
6.1 Processing is carried out in accordance with our Privacy Policy. By using the Beta, you explicitly consent to the processing of your health data for the purpose of testing the analysis algorithms.
7. Final Provisions
7.1 We reserve the right to modify these Terms at any time. Updated versions will be communicated to users through our website or other appropriate means. Continued use of the software will be considered as acceptance of the modified Terms.
7.2 The German version of this Product Disclaimer is legally binding, even for international users. All other language versions are provided as non-binding translations. In case of doubt, the German original version shall prevail.
7.3 Substantive Swiss Law applies. The place of jurisdiction is Zug, Switzerland.
